1. Scope and provider
These terms apply to all orders placed through bundlethemes.com. The provider and your contracting party is Julius Elias Gebler, Buckelwiesen 7, 82481 Mittenwald, Germany, email: hello@bundlethemes.com (“we”).
The offer is intended for consumers and businesses residing or established in a member state of the European Union.
2. What you buy
We sell themes for Shopify stores as digital content. You receive them as ZIP files for download; nothing is shipped.
There are three packs. Which themes belong to a pack and what it costs is shown in the order form:
– Niche pack: four themes of one niche
– All 20 themes: all twenty themes, each as its own ZIP file, plus one ZIP file with all of them
– Agency license: the same content as “All 20 themes” with an extended license (section 6)
To use a theme you need a Shopify store (Online Store 2.0). The store and its costs are not part of our offer. The themes come with texts in English and German and without products, images or demo content. Shopify is a trademark of Shopify Inc.; we have no business relationship with Shopify.
3. Conclusion of the contract
The presentation of the packs on the site is not yet a binding offer. In the order form you choose a pack, enter your email address and your country, and confirm the two mandatory fields. You can change all entries until you submit the form. By clicking the button “Order and pay” you place a binding order and are taken to the payment page.
The contract is concluded as soon as we have received your payment and make the download available to you. We confirm this by email. If no payment is received (canceled, failed or expired), no contract is concluded.
We store the data of your order and the version of these terms that you accepted. You receive the data of your order with the confirmation email; you can open and save these terms on this page at any time.
The order form is available in German, English, French, Spanish, Italian, Dutch, Polish and Portuguese. These terms are available in German and English; if the versions differ, the German version prevails.
4. Prices and payment
The price shown in the order form when you submit your order applies. Prices are final prices in euros for a single payment; no subscription is created. The note on VAT is shown in the order form and on the invoice. There are no shipping costs.
You can pay with the payment methods offered to you during checkout. Payments are processed by the payment service provider Mollie B.V. on its payment page and are due immediately. You receive an invoice as a PDF with the confirmation email and on your download page.
5. Delivery
Right after the payment has arrived we show you the link to your download page and send it to your email address. The link is valid for seven days. Each file can be downloaded five times through it. Please keep your own copy of the files after downloading.
If the link has expired or the limit is reached before you were able to save the files, write to hello@bundlethemes.com with your order number and we will issue a new link.
6. License
On full payment you receive a non-exclusive right, unlimited in time, to use the themes of your pack. The scope depends on the pack:
– Niche pack and All 20 themes (license for one store of your own): You may use the themes in one online store that you operate yourself, including its development and test environments.
– Agency license: You may use the themes in any number of online stores, your own and those of your clients. You may set up a theme for a client and leave it in the client’s store; the client may use it there.
For all packs: You may adapt and modify the themes for your store. You may not resell, give away, publish, offer for download or pass on as a template the themes themselves, individually or as a pack, modified or unmodified. The license for one store of your own is not transferable.
7. No promise of updates or support
You buy the themes in the state they are in at the time of purchase. We do not promise new versions, new features or further development. We do not offer individual support, setup or customization; the installation guide and the help page on this site explain the installation. If something went wrong with your payment or download, hello@bundlethemes.com will help.
Your statutory rights remain unaffected (section 9).
8. Right of withdrawal
Consumers have a statutory right of withdrawal. The details, the expiry of the right of withdrawal for digital content and the model withdrawal form are set out in the information on the right of withdrawal on this site.
9. Rights in case of defects
The statutory rights in case of defects apply. For consumers these are the provisions on contracts for digital products (§§ 327 et seq. of the German Civil Code, BGB), including the statutory duty to provide updates that are necessary to keep the product in conformity with the contract.
10. Liability
We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act and to the extent that we have given a guarantee.
In cases of slight negligence we are liable only if we have breached an essential contractual obligation, that is, an obligation whose fulfilment makes the contract possible in the first place and on which you may rely. Liability is then limited to the damage that is typical and foreseeable for contracts of this kind. Any further liability is excluded.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the state in which you have your habitual residence remain applicable.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Should a provision of these terms be invalid, the remaining provisions remain in effect.
